These Terms & Conditions (“Terms”) form a binding agreement between you and Glamaritz Pty. Ltd. (“Glamaritz”, “we”, “us”, “our”) governing your use of this website (the “Site”) and any purchase of products or services through the Site.
By accessing, browsing, or using this Site or ordering any products, you agree to be bound by these Terms in full.
1. Definitions In these Terms, unless the context requires otherwise:
· Account: Your personal profile on the Site.
· Affiliate: A person or entity related to Glamaritz by ownership, control or common control.
· Buyer / Customer / You: Any person using this Site or purchasing Products.
· Products: Jewellery and any other goods or services made available for sale on the Site.
· POPIA: Protection of Personal Information Act, 2013 (South Africa).
· Write/ Written: Includes electronic communication.
2. Acceptance 2.1 These Terms apply to your use of the Site and all transactions concluded through it. 2.2 By using this Site or completing a purchase, you confirm that:
· You have reached the age of majority (18+);
· You are legally capable of entering into binding contracts;
· You agree to comply with these Terms.
3. Account Registration & Security 3.1 To place orders you may be required to register and create an Account. 3.2 You agree to:
· Provide accurate, current, and complete information;
· Update your details to keep them current;
· Maintain the confidentiality of your login credentials;
· Accept responsibility for all activities that occur under your account. 3.3 Glamaritz may suspend or terminate access for any breach of these Terms.
- Use of the Site 4.1 You agree that you will not misuse the Site (including without limitation accessing it to damage, manipulate, hack, interfere with content, violate intellectual property rights, or transmit harmful content). 4.2 You must not use the Site for unlawful purposes or to infringe rights of others.
- Privacy & Personal Information 5.1 We collect and process personal information to manage your account, process orders, deliver Products, communicate with you, and comply with legal obligations. 5.2 We comply with POPIA and applicable South African data protection laws. 5.3 You consent to the processing of your personal information, including sharing to:
· Payment gateways and financial institutions;
· Courier, delivery, logistics partners;
· Analytics, marketing service providers;
· Regulatory bodies as required by law. 5.4 You have the right to:
· Request access to your personal information;
· Request correction or deletion;
· Object to processing (where lawful);

- Ordering & Formation of Contract 6.1 All orders placed are subject to acceptance by Glamaritz. 6.2 Product availability, pricing, and estimated delivery times are displayed on the Site but are not guaranteed. 6.3 A binding contract of sale is formed when Delivery occurs or the Product is accepted by you; until then, Glamaritz may cancel orders with a full refund.
- Prices & Payment 7.1 All prices are in South African Rand (ZAR) and may include VAT where applicable. 7.2 Payment must be made in full at the time of purchase using the Site’s available methods (credit/debit card, EFT or other gateways). 7.3 You warrant you are authorised to use the payment method supplied. 7.4 You expressly accept risk of any payment decline caused by your banking institution.
- Delivery 8.1 Delivery Fees will be communicated at checkout. 8.2 Delivery addresses must be accurate and accessible; additional charges may apply for failed delivery attempts. 8.3 Delivery timelines are estimates only. 8.4 Risk of loss or damage passes to you upon delivery. 8.5 If reasonable delivery time is unacceptably delayed, you may cancel and obtain a refund (excluding delivery costs) in accordance with consumer law.
- Returns, Refunds & Cancellations 9.1 Consumer Protection Rights: In terms of the Consumer Protection Act (CPA), defective or not-as-described Products may be returned within a reasonable time. 9.2 Change-of-Mind Returns: Unused Products in original condition may be returned within 7 working days of delivery for a refund (excluding delivery costs). Customised jewellery is excluded. 9.3 Defective Products: Reported defects within 6 months of delivery will be assessed. If defective, we may at our option repair, replace, or refund. 9.4 Goods Purchased with Gift Cards: Refunds may be credited to Gift Cards. 9.5 Cancellation: Orders cannot be cancelled once paid and dispatched, unless required by law.
- Warranty 10.1 Manufacturer warranties may apply. 10.2 Warranty does not extend to wear caused by misuse, neglect, accidental damage, or unauthorised repair.
- E-Gift Cards & Digital Vouchers 11.1 Gift Cards issued by Glamaritz are redeemable online or as specified by us. 11.2 Gift Cards:
· Cannot be exchanged for cash except where required by law;
· Cannot be refunded once activated;
· Cannot be used to settle outstanding account balances. 11.3 Lost or stolen Gift Cards may be blocked, but replacement is at our discretion and subject to proof of unused balance. 11.4 Gift Card expiry date, if any, will be communicated at time of purchase.
- Services (Repairs, Valuations & Ring Sizing) 12.1 Where offered by Glamaritz, services such as repairs, valuations or ring sizing require proof of purchase. 12.2 You warrant you are the legal owner of goods presented for service. 12.3 A complimentary quotation will be provided. Acceptance and any required deposit are needed before work begins. 12.4 Repaired goods remain your responsibility until collection. 12.5 We may refuse service for misuse, alteration, or age of goods and are not liable for incidental delays. 12.6 You release us from all liability for loss, damage, or change in characteristics of goods handled for services; you undertake to insure items and indemnify us against claims (including from third parties).
- Complaints Handling 13.1 Our customer service team aims to resolve complaints promptly. 13.2 Complaints should be submitted in writing to [Insert Complaints Contact]. 13.3 We aim to acknowledge complaints within 5 business days, investigate, and provide a resolution or response within a reasonable period. 13.4 If unresolved, you may refer to appropriate dispute resolution bodies under South African law.
- Language Policy 14.1 These Terms are drafted in English. Translations (if any) are for convenience only. 14.2 In the event of inconsistency, the English version prevails.
- Liability 15.1 To the extent permitted by law, Glamaritz, its directors, employees, and agents exclude all liability for:
· Indirect, special, incidental, consequential damages;
· Loss of data, profits, or business interruption. 15.2 Our aggregate liability for direct damages will not exceed the purchase price you paid.
- Intellectual Property All content (text, graphics, images, logos) on the Site is proprietary. You may not use it without our written consent.
- Amendments We may update these Terms from time to time. Updated Terms will be posted on the Site with a new Effective Date. Your continued use after changes constitutes acceptance.
- Governing Law & Jurisdiction These Terms are governed by the laws of South Africa. Any disputes shall be subject to the non-exclusive jurisdiction of South African courts.
